1. Purpose and acceptance
These terms govern access to and use of the derush.tv service. derush.tv helps Twitch streamers and their teams go through their VODs, spot the good moments, edit them into short clips and publish them.
Creating an account constitutes acceptance of these terms, of the privacy policy and of the data processing agreement. That acceptance is timestamped and kept, together with the version accepted; you can request a copy at any time.
Three documents complete this one and form part of it: the privacy policy, describing how your data is processed; the data processing agreement, covering what we process on your behalf about your community; and the legal notice, identifying the publisher. Where they conflict on a data protection matter, the data processing agreement prevails.
2. Service publisher
The service is published by Vincent Brach, sole trader. Full identity, registration, address and contact details are set out in the legal notice.
General contact: [email protected]. Data protection questions: [email protected]. Content reports: [email protected].
3. What the service does
derush.tv brings together several functions around a single Twitch channel: importing and playing back VODs, taking notes and segments during or after the stream, markers submitted by viewers through a Twitch extension, chat and audio analysis, short-clip editing in a built-in editor, and publishing.
The service relies on third-party platforms — Twitch first and foremost — whose availability, access conditions and technical changes are outside our control. A change to their interfaces may suspend or remove a feature without the publisher being responsible for it.
4. Account, age and security
You can sign up with an email address or through a Twitch, Google or Discord account. The information you provide must be accurate and kept up to date.
You are responsible for keeping your credentials confidential and for any activity carried out from your account. Two-factor authentication is available and recommended. Tell us straight away at [email protected] if your account is used without your authorisation.
An account is personal. You may, however, invite members to your channels and grant them permissions: you remain responsible for what they do in that capacity.
5. Your content
You keep every right you hold in the content you import or produce with the service: VODs, clips, edits, notes, images, sound. The publisher acquires no ownership in it.
You grant us only the technical licence needed to run the service: hosting your files, transcoding them, generating thumbnails and transcripts, computing renders, and delivering them to the people you give access to. That licence is non-exclusive, limited to that purpose, and ends when the content is deleted.
You warrant that you hold the rights needed for what you import, including any third-party music, images and excerpts, and the image rights of people appearing in your videos.
6. Prohibited uses
The following are prohibited, without this list being exhaustive:
- publishing or distributing unlawful content, in particular infringing, defamatory or hateful content, or content invading someone's privacy;
- using the service to harass someone, or to build a file on a viewer outside the moderation of your own community;
- circumventing the quotas, credits or technical restrictions of the service;
- attempting to reach data or channels that are not open to you;
- reselling, redistributing or otherwise making access to the service available to third parties;
- automating usage to the point of degrading the service for other users.
7. Reporting unlawful content
The service hosts content and allows it to be distributed. Under Article 16 of the European Digital Services Act, anyone may report content they consider unlawful.
Reports go to [email protected] and must include: the exact location of the content, the grounds for the report, a sufficiently substantiated explanation, and the contact details of the person reporting.
- An acknowledgement of receipt is sent without delay.
- The decision is notified to the person reporting, with reasons, and states the available remedies.
- Where content is removed or disabled, the person who published it is informed, with reasons, and may challenge the decision at the same address.
8. Subscriptions and credits
The service is offered in subscription tiers. Each tier opens a volume of credits renewed every period, a storage quota and a set of features.
Credits are the unit of consumption. Operations that incur compute or storage cost — video rendering, transcription, automatic analysis — are charged in credits, and their cost is shown before they run.
- Credits included in a subscription are valid for the current period and do not roll over.
- Credits are not transferable, not convertible into money, and not refundable.
- The credit cost of an operation may change; any unfavourable change is announced under the conditions in article 9.
- Exceeding the storage quota suspends the addition of new files; existing files are not deleted.
Subscriptions are taken out and managed through Stripe. They renew automatically at the end of each period unless cancelled. You can cancel at any time from your account: access continues until the end of the period already paid for, and no further payment is taken.
9. Prices and price revision
Prices are shown in euros on the pricing page, as the total amount payable. The publisher is under the French VAT franchise scheme: the statement « TVA non applicable, article 293 B du CGI » appears on invoices, and no VAT is charged or recoverable.
Any revision is subject to the following guarantees, which apply cumulatively:
- at least thirty (30) days' notice before it takes effect;
- individual notice by email, not merely an update to the pricing page;
- the right to cancel with no penalty or charge up to the effective date, for any customer who does not accept the new price;
- an annual subscription already paid for runs to its end at the agreed price, with no revision mid-period;
- a monthly subscription is revised only from the renewal following the notice.
The publisher may, without being obliged to, keep the previous price for existing subscribers.
10. Right of withdrawal
A consumer normally has fourteen (14) days to withdraw from a distance contract (article L221-18 of the French Consumer Code).
If you would rather not waive that right, do not subscribe and write to us at [email protected]: access can be opened once the fourteen-day period has elapsed.
11. Refunds
As the waiver is given on subscription, amounts paid are not refundable as of right.
The publisher may nonetheless grant a refund as a commercial gesture, assessed case by case, generally calculated pro rata for the unexpired period, less services already consumed — credits used, storage occupied, renders produced. Send a reasoned request to [email protected].
This does not affect the rights the law gives you where the service is not as described or the publisher fails to meet its obligations.
12. Offer for small channels
A channel with 500 followers or fewer when its Twitch account is linked receives a subscription tier free of charge.
The offer is reassessed periodically. If the channel stays above the threshold, the offer ends as follows:
- thirty (30) days' notice is given by email before anything is withdrawn;
- during that notice period, access is unchanged;
- if the channel drops back below the threshold during the notice period, the notice is cancelled and the offer kept;
- at the end of the notice period, the account returns to the free tier; content already produced remains accessible within the limits of that tier.
13. Availability and changes
The publisher takes reasonable steps to keep the service available, without guaranteeing uninterrupted continuity. Interruptions may occur for maintenance, updates, technical incidents, or because of a third-party platform.
Scheduled interruptions are announced where possible. The service evolves: features may be added, changed or removed. Removing a substantial feature from a paid tier is notified under the notice conditions in article 9 and opens the same right to cancel.
The service is provided as is, with no guarantee as to the relevance of automatic detections, the quality of transcriptions or the performance of published content.
14. Suspension and termination
You may terminate at any time by deleting your account from your settings, or by writing to [email protected].
The publisher may suspend or terminate an account for breach of articles 5, 6 or 7, for non-payment, or for use that compromises the security or stability of the service. Except in an emergency or where illegality is manifest, suspension is preceded by a formal notice left without effect for fifteen (15) days.
Termination for breach gives no right to a refund.
15. End of contract and what happens to your data
You can export your data from your settings at any time, including before deleting your account.
Deleting your account deletes the data identifying you, deletes the channels you own together with their VODs, projects and files, and anonymises contributions you left on channels belonging to other people — so as not to destroy their work. The detail is set out in the privacy policy.
16. Personal data
How your data is processed is described in the privacy policy. It sets out what is collected, how long it is kept, who receives it and how to exercise your rights.
For the data you have processed about your community — messages from your channel's chat, markers from your viewers, content you import — you are the controller and the publisher acts as processor. The data processing agreement sets the conditions, in accordance with Article 28 GDPR.
17. The publisher's intellectual property
The service, its code, its interfaces, its trade marks and its graphic elements are protected and remain the property of the publisher. A subscription grants a personal, non-exclusive right of use for the term of the contract, and nothing further.
Copying, decompiling, reverse-engineering and substantial extraction from the service's databases are prohibited, save for the exceptions allowed by law.
18. Liability
The publisher is liable for direct loss caused by a failure to meet its obligations. It is not liable for indirect loss, in particular loss of audience, advertising revenue, opportunity or partnership.
The publisher is not liable for the unavailability, modification or removal of a third-party service a feature depends on, nor for the content you publish, nor for the consequences of losing your credentials.
19. Changes to these terms
These terms may be changed. Any substantial change is notified by email, to the address linked to your account, at least thirty (30) days before it takes effect. The version in force and its date are shown at the top of this document.
Refusing the new version gives the right to cancel without penalty up to its effective date. Continuing to use the service after that date constitutes acceptance.
20. Governing law and dispute resolution
This contract is governed by French law. The French version is authoritative; this English version is provided for information only and never prevails.
If something goes wrong, first send a written complaint to [email protected]. We undertake to reply within fifteen (15) days.
Failing an amicable resolution, disputes fall to the competent French courts. A consumer may also bring proceedings before the court where they are domiciled.
